Minutes: April 16, 2012

The regular meeting of the Municipal Utilities Authority (MUA) of the Township of Vernon was convened at 7:00 p.m. on Monday, April 16, 2012 in the Vernon Municipal Center, 21 Church Street, Vernon, New Jersey.

Statement of Compliance

Adequate notice of this meeting had been provided to the public and the press on December 18, 2011 and was posted on the bulletin board in the municipal building in accordance with the Open Public Meetings Act, N.J.S.A. 10:4-6.

Mandatory Connection Notice

MUA secretary read the Notice of Mandatory Connection.

Motion to approve the Notice of Mandatory Connection as read, and authorize the secretary to distribute.

Motion for Resolution 12-03 amending the quarterly billing dates.

Resolution #12-03: Resolution of the Vernon Township Municipal Utilities Authority Amending the Quarterly Billing Date

WHEREAS, the Vernon Township Municipal Utilities Authority (“VTMUA”) periodically reviews its Rules and Regulations;

WHEREAS, it has been recommended by the administration and the Finance Office that Section 4.1B of the VTMUA Rules and Regulations be amended;

WHEREAS, the VTMUA has considered this recommendation and is in agreement;

NOW THEREFORE IT BE RESOLVED that the Rules and Regulations of the VTMUA are hereby amended to indicate that the quarterly billing date as set forth in Section 4.1B shall be changed to February 1st, May 1st, August 1st and November 1st of each year.

NOW THEREFORE IT BE FURTHER RESOLVED that the Clerk of Board shall keep this resolution in a binder with the adopted Rules and Regulations as an official record of the VTMUA.

Brian Lynch, Vernon Township Council President, expressed his gratitude to the Vernon Township Municipal Utilities Authority as well as the MUA professionals for their work leading Vernon Township forward in a positive direction.

Budget and Rate—Public Hearing

Mr. Ferraioli advised that the Department of Community Affairs had verbally approved the 2012 budget. It was explained that the MUA budget had 1revenue and 2 appropriations. Total revenues were stated to be $656,000 coming from unused bond proceeds. $100,000 was budgeted for other expenses under administration, and $556,000 for other expenses under plan operations, which were predominantly payments to SCMUA debt service.

The bills list was tabled until the next meeting.

Engineer Update

Mr. Rolak stated that a submission for the A&P Shopping Center was received, however, there were no executed copies. Mr. Rolak advised that he would notify the applicant that executed copies were necessary to review the application further.

Minor modifications to the MUA Sewer Application forms were reviewed. A request for 2 electronic copies of all documents in addition to hard copies was added to the form.

Schedule B was reviewed regarding the number of EDUs for Town Center properties in the sewer service area.

MUA Discussion

Ms. Chorzepa questioned if the economic development committee was being notified of the sewer system becoming operational. Mr. Zinno asked the secretary to contact the Vernon Township Economic Development Committee to make them aware of the status of the sewer operation.

The exemption from connection fees of municipal building, fire department and board of education property was questioned. It was noted that municipal property was exempt from connection fees per the Rules and Regulations. The question of whether the fire department and board of education were exempt from connection fees was tabled until the next meeting when the MUA would consult with their attorney, John Ursin, Esq.

Mr. Zinno advised that he spoke with D&H Alternative Risk Solutions regarding Mr. Kastner obtaining the proper insurance necessary to accept the sewer operator position with the MUA. Mr. Kastner’s potential status as an employee of either the township or the MUA was discussed. Mr. Ferraioli advised that the MUA hiring an employee was not reflected in the budget. This was tabled until the next meeting for input from Mr. Ursin.
