Call to Order

The regular meeting of the Vernon Township Municipal Utilities Authority (VTMUA) of the Township of Vernon was convened at 7:00 p.m. on Thursday, August 20, 2015 in the Vernon Municipal Center, 21 Church Street, Vernon, New Jersey.

Statement of Compliance

Adequate notice of this meeting had been provided to the public and the press on January 15, 2015 and was posted on the bulletin board in the municipal building in accordance with the Open Public Meetings Act, N.J.S.A. 10:4-6.

5. Correspondence

Letter from Wallkill Valley Memorial Post 8441 VFW

Letter requesting an additional one-year extension to connect to the sanitary sewer as previously provided for in the VTMUA approved Resolution 14-27 titled VFW Hardship Connection Deferral.

Jim Davis, Post Commander of VFW Post 8441, sent a letter requesting an extension for hookup to the sewer. He stated there had previously been a lack of communication with the VTMUA but assured the failure had been corrected. Mr. Davis said the financial health of the VFW has improved and distributors have extended credit and the VFW utility bills are now current. The Badge of Honor Society has committed to a series of musical concerts to be held at the VFW post with all proceeds from the concerts allocated to the post’s VTMUA obligations, but the post needs more time to raise money for the connection fee.

Motion to receive and file the correspondence was made by Gloria Gallo.

6. Other Resolutions

A. Resolution 15-39: Approving the Activation of a One-Year Extension, Until June 30, 2016, for the Wallkill Valley Memorial Post 8441 to Connect to the Vernon Sanitary Sewer System

The VTMUA granted the one-year extension to June 30, 2016. Should the health department confirm that the VFW’s existing septic system stops working properly and/or needs major repair or replacement, the VFW will be required to connect to the sewer system immediately.

The motion to grant the one-year extension was made by Gloria Gallo.

B. Resolution 15-40: Hardship Authorizing a Refund of Sewer Fee Overpayment for Block 144.01 Lot 3, Red Oak Properties

This resolution is for overpayment of $157.50 by Red Oak Properties at 306 Route 94, in Vernon.

C. Resolution 15-41: Authorizing the Refund of Overpayment in Sewer Fees for Block 144.01 Lot 3, Tara Properties

This resolution is for overpayment of $1620.00 by Tara Properties at 5 Church Street, in Vernon. The owner wishes the overpayment to be applied to the connection fee owed to the VTMUA, which is being made in installments according to a hardship payment plan.

9. Engineer’s Report

A. Review of New Applications

Executive Director John Scerbo reported in Engineer Ceren Aralp’s absence. Tara Properties at 5 Church Street, Vernon, Block 144.01 Lot 3, was assessed 1.75 EDUs for retail businesses and a two-bedroom apartment. A camera store is located on the property. Commissioner Thomas Buchney expressed concern about chemicals used for the photography business in the building. He asked if there was a way to monitor them. John Scerbo said a private service picks up the chemicals for disposal. The approval specifies that chemicals used for photographic development shall not be discharged into the VTMUA system and must be disposed offsite.

B. Old Business

There was no old business. VTMUA Chairman Vincent Zinno asked the executive director to report at the next meeting on the status of the CVS Pharmacy being constructed at the intersection of Route 94 and Main Street.

10. Executive Director’s Report

Executive Director John Scerbo briefly reported on the insurance risk fund. He said he filed a grant application on behalf of the VTMUA for the statewide insurance fund, and while it is not a significant amount, the grant will give the VTMUA back 10% of the annual premium. The money will be used to pay for a portion of the camera system the VTMUA uses to view sewer pipes and won’t have to use outside services to do the work.

11. Commissioner Comments

Commissioner Thomas Buchney asked for the status of the easement on the Zimmerman property where there was an abandoned septic system and tank. The township had purchased an easement from Mr. Zimmerman when he connected to the sewer. VTMUA Attorney Richard Wenner told the commissioners the onus to take care of the abandoned system and close the tank lies with the township.

12. Chairman Comments

Chairman Vincent Zinno thanked Executive Director John Scerbo for staying on top of the grants and the daily operations of the VTMUA.
