Minutes: August 21, 2014

Call to Order

The regular meeting of the Vernon Township Municipal Utilities Authority (VTMUA) of the Township of Vernon was convened at 7:00 p.m. on Thursday, August 21, 2014 in the Vernon Municipal Center, 21 Church Street, Vernon, New Jersey.

Statement of Compliance

Adequate notice of this meeting had been provided to the public and the press on January 2, 2014 and was posted on the bulletin board in the municipal building in accordance with the Open Public Meetings Act, N.J.S.A. 10:4-6.

Gloria Gallo was detained at her job and was unable to attend the meeting. Roy Tanfield was also out of town on business and unable to attend the meeting. Both were excused.

Professional Staff Present

Attorney John Ursin, Engineer John Rolak, and Executive Director John Scerbo were also present.

1. Oath of Office

John Ursin administered the Oath of Office to Phyllis Pfeifer for her new position on the VTMUA as Alternate #1.

2. Open Meeting for Public Comment

Motion to open the meeting to the public was made by Thomas Buchney.
Seconded by Phyllis Pfeifer

Gary Martinsen of Vernon came forward. He stated his opposition to the VFW getting a one-year waiver of hookup requirement and wanted to see it for a longer time. He also said the VFW would be charged for usage, even though they are not hooked up to the sewers, and questioned whether the VTMUA could do that.

Len Collocia of Great Gorge Village said he is only in favor of granting the VFW a waiver as long as the VTMUA grants a waiver for anyone else who presented a hardship case. He said if others with hardship cases are already hooked up, the VTMUA should refund their money. By granting a waiver to the VFW, they VTMUA is showing prejudice against the churches that had to pay and hook up when they had hardships as well, he said. He wants to see the waivers granted to everyone who claimed hardships. He also questioned how Brookside Florist paid for hookup fees and is paying usage fees when they are not hooked up to the sewers. He questioned why a connection fee is charged when the florist is not connected. He asked what gives the VTMUA the authority to grant a waiver. Mr. Collocia argued whether the VTMUA had the right to grant waivers. He also accused commissioner Roy Tanfield of alleged statements that were not made at a VTMUA meeting and asked the VTMUA to take a vote to remove Mr. Tanfield from the commission. Chairman Vincent Zinno said the VTMUA would not discuss Mr. Collocia’s accusations and allegations.

Christa Geary of Vernon said she was disappointed the VFW received only a two-year extension and was hoping the VFW would have been exempted completely.

6. Resolutions

A. Resolution 14-27: Approval of a Hardship Connection Deferral for the VFW

The VFW will be assessed at 4.5 EDUs. Attorney John Ursin said the resolution grants the VFW a two-year extension, dated back from July 1, 2013 for their mandatory connection. He said all properties in the sewer service district that were subject to mandatory connections have all paid EDU fees from July 1, 2013 forward. Some applicants have asked for a change in that date, but for consistency all EDU rates began on July 1, 2013 for all ratepayers. Similarly, the VFW will get a deferral for a two-year period, dating back to July 1, 2013. Mr. Ursin said it is a uniform accommodation for all users on the system and is uniform with state statutes.

The motion to approve the resolution was made by Phyllis Pfeifer.

9. Engineer’s Report

A. New Business—Review of Applications

1. Approval of EDU Flow Count for Block 142, Lot 2 at 515 Rte. 515, Keough Property

Engineer John Rolak said this property is allocated 1 EDU. The engineer’s report specifies that the drawing submitted with this application must be revised and resubmitted. The applicant must also show property lines on the drawing, along with all existing structures and proposed lateral. Proposed lateral shall not be placed over abandoned structures. Cleanouts should be installed. The proposed lateral must be constructed to specification, and the slope of the gravity pipes shall not be less than 1/4 inch per foot. The existing septic tank and distribution box must be abandoned per VTMUA rules and regulations.

James Kensek made a motion to approve, contingent upon the engineer’s recommendations.
Phyllis Pfeifer seconded the motion.

2. Approval of EDU Flow Count for Block 141, Lot 12.01 and Lot 13 at 293 Rt. 94, Vernon Board of Education/Historical Society

The property is allocated .25 EDU based on change of use.

A motion to approve was made by Vincent Zinno.
James Kensek seconded the motion.

Discussion: James Kensek noted a typo in the engineer’s report and corrected the year from 2015 to 2014. He also questioned if the township officially owns the building and if it did, would it affect the status of the application. Attorney John Ursin said it would not, unless the use changed.

3. Approval of EDU Flow Count for Block 144.01, Lot 9 at 537 Rt. 515, Vernon Township Fire Dept. No. 1

This property was allocated 1 EDU. There are five service bays and no floor drains.

A motion to approve was made by Phyllis Pfeifer.
Vincent Zinno seconded the motion.

B. Old Business

Executive Director John Scerbo said the county has confirmed it does have a pump truck, but due to manpower cuts the truck is not readily available. If the truck is needed by the township, the town should call the county but the determine of whether it is available would be made on a case-by-case basis.

12. Chairman Comments

Vincent Zinno thanked Bill Benneyan of Mountain Creek for coming to the VTMUA meeting and for helping the VFW financially. Mr. Benneyan came forward and announced that Mountain Creek is donating the money to cover the VFW’s arrears to date.

Mr. Ursin stated that Mountain Creek’s donation to the VFW was not part of the VFW resolution or the VTMUA’s negotiations with the VFW. The VTMUA did not know about it until just a short time ago, and the resolution had been drafted more than one month ago.
