Call to Order

The regular meeting of the Vernon Township Municipal Utilities Authority (VTMUA) of the Township of Vernon was convened at 7:00 p.m. on Thursday, February 26, 2015 in the Vernon Municipal Center, 21 Church Street, Vernon, New Jersey.

Statement of Compliance

Adequate notice of this meeting had been provided to the public and the press on January 15, 2015 and was posted on the bulletin board in the municipal building in accordance with the Open Public Meetings Act, N.J.S.A. 10:4-6.

1. Administration of Oath of Office

Attorney Richard Wenner administered the oath of office to Thomas Buchney, who will be serving a five-year term that will expire in February 2020.

2. Roll Call of Professional Staff Present at the Meeting

Attorney Richard Wenner, Engineer Ceren Aralp, Auditor Charles Ferraioli, and Executive Director John Scerbo were present.

3. Election of VTMUA Chairperson

James Kensek moved to nominate Vincent Zinno chairman of the VTMUA.

4. Election of VTMUA Vice-Chairperson

James Kensek moved to nominate Thomas Buchney vice-chairman of the VTMUA.

11. Attorney’s Report

Attorney Richard Wenner reported he was in contact with Mountain Creek’s attorney regarding Mountain Creek’s 2015 fourth quarter unpaid sewer bill, which is about $32,000. Mr. Wenner expects to resolve the matter shortly.

12. Auditor’s Report

Auditor Charles Ferraioli discussed the VTMUA’s trust fund program financing, debt service, expansion, and infrastructure repairs. He gave the commissioners a spreadsheet on the finances. He suggested that VTMUA engineer Ceren Aralp could contact the New Jersey Department of Environmental Protection to see what grants or offers might be available to the VTMUA for additional sewer service areas and lift station repairs within the sewer service area. He also suggested a meeting between the VTMUA and the NJ Environmental Infrastructure Trust.

Edward Snook moved to authorize Ceren Aralp to contact the NJDEP to set up a meeting to discuss the expansion of sewer service areas and lift stations. Vincent Zinno seconded the motion.

Further Discussion: Commission Thomas Buchney asked which lift stations they were referring to. Ceren Aralp responded the four lift stations at the condominiums.

Mr. Ferraioli said the township should also be present for the meeting. Vincent Zinno directed Executive Director John Scerbo to notify the mayor, township CFO, and business administrator about the meeting.

13. Engineer’s Report

A. Fersch House—Block 144 Lot 30, 541 Route 515—Approval of 1 EDU Flow Count

Motion to approve was made by James Kensek.

Further Discussion: Executive Director John Scerbo reported that this property was summonsed for failure to hook up to the sewers, and a court hearing is pending on March 10.

B. CVS—Block 144.01 Lot 1, 2, 3 at Intersection of Route 94 and Main Street

Engineer Ceren Aralp reported that she received and reviewed the sanitary sewer connection drawings for the property and made the following recommendations:

  1. The utility crossing detail shall allow sanitary sewers to be wrapped with one-inch foam.
  2. The existing sewer location and elevation shall be confirmed during construction with test pits.
  3. The applicant must comply with all the rules and regulations of the VTMUA and local plumbing codes.

C. Dunkin Donuts—Block 141, Lot 18, 399 Route 94

The engineer has received revised drawings but has some additional concerns, for which she has not yet received a response from the applicant. Executive Director John Scerbo said they are very far behind in not having met their July 1, 2013 deadline for connection.

D. H & H Plaza

Ceren Aralp has a number of concerns but has not received revised drawings and has not been able to reach the owner of the plaza. Executive Director John Scerbo said this application has been an arduous situation and a lack of compliance.

E. Valley View Apartments

Ceren Aralp got a call from their contractor and she forwarded a letter of concerns to him. John Scerbo said the property owner told him he could not afford sewer hook up. Mr. Scerbo suggested they apply for a hardship plan to make payments over a five-year period. He warned the property owner a summons would soon be served if there is no compliance.

F. A&P Shopping Plaza

Ceren Aralp reported this applicant is still on hold because of the applicant’s inability to complete connection due to the weather. Mr. Scerbo reported they need to increase their escrow and has notified them several times about it, but they have failed to date to comply in increasing it. Their current bill amount exceeds the amount being held in escrow. Ceren Aralp also reported that their contractors do not show up for inspections, or they do not come with the appropriate materials.

14. Executive Director’s Report

Executive Director John Scerbo reported there was a problem with the lift station for Kites Restaurant. The pumps needed to be replaced. Contractors for the restaurant took care of it and are also replacing grease traps. The problem with the lift station at Kites resulted in VTMUA overtime costs for manpower. Mr. Scerbo said the overtime costs were recouped by the cleanout of VTMUA lines and the tank at the pump station at no cost to the VTMUA, as well as a $2,500 credit at Earth Care for future VTMUA needs.

15. Commissioners’ Comments

Thomas Buchney recommended the VTMUA send a letter of thanks to former attorney John Ursin for his service to the VTMUA. The commissioners also approved the allocation of up to $250 for a gift for Mr. Ursin. The suggestion was made to send flowers and a plaque. All of the commissioners were in favor of the gift and the letter of thanks.

16. Chairman Comments

Chairman Vincent Zinno appointed Thomas Buchney and Phyllis Pfeifer to the newsletter committee. He also appointed James Kensek and Edward Snook to the bills committee. He also thanked all of the professionals for the good work they did in 2014.

17. Executive Session—Potential Litigation

WHEREAS, the Open Public Meetings Act, N.J.S.A. 10:4-6 permits the exclusion of the public in certain circumstances; and

WHEREAS, this public body is of the opinion that such circumstances presently exist.

NOW, THEREFORE, BE IT RESOLVED by the Vernon Township Municipal Utilities Authority of the Township of Vernon as follows:

1. The public shall be excluded from discussion of and action upon the hereinafter-specified subject matter.
2. The general nature of the subject matter to be discussed is potential litigation.

Vincent Zinno, VTMUA Chairman, asked for a motion to go into executive session.

No action will be taken after the executive session when the public session reconvenes.

Return to Open Session

The VTMUA came out of executive session at 8:30 p.m. and reconvened public session.

Attorney Richard Wenner stated that the Executive Session had been for the purpose of discussing potential litigation.
