Call to Order

The regular meeting of the Vernon Township Municipal Utilities Authority (VTMUA) of the Township of Vernon was convened at 8:09 p.m. on Thursday, March 19, 2015 in the Vernon Municipal Center, 21 Church Street, Vernon, New Jersey.

Statement of Compliance

Adequate notice of this meeting had been provided to the public and the press on January 15, 2015 and was posted on the bulletin board in the municipal building in accordance with the Open Public Meetings Act, N.J.S.A. 10:4-6.

2. Open Meeting for Public Comment

Motion to open the meeting to the public was made by Edward Snook.

The public portion of the meeting was declared open. No one from the public came forward.

3. Close the Meeting for Public Comment

Phyllis Pfeifer moved to close the meeting to the public.
Edward Snook seconded the motion.

B. Old Business

Dunkin’ Donuts—Block 141 Lot 18

The engineer said she received a revised drawing from applicant Vernon Merritt, but she sent him another letter with more questions that need to be answered. Ms. Aralp said this is the third round of drawings and letters with the applicant and the submission and completion of an acceptable application and VTMUA approval are not getting any closer. She said she is not permitted to give the applicant a design for the connection. The applicant has to submit one to the VTMUA for approval. She asked the commissioners how far they continue to keep reviewing what the applicant submits before an acceptable design is submitted. She suggested assessing the applicant additional escrow fees. The applicant is very far behind the July 1, 2013 VTMUA deadline for connection.

C. Valley View Apartments

Ms. Aralp reported that she as not seen any drawings from this applicant yet. Last month, the property owner had told Executive Director John Scerbo that he could not afford connection fees. Mr. Scerbo suggested the owner apply for a hardship situation that would allow him to pay the fees over a five-year period and had warned a summons would soon be issued for failure to comply with VTMUA regulations. Ms. Aralp said she has not yet gotten any further correspondence from the owner since then.

10. Executive Director’s Report

Executive Director John Scerbo reported that there has been a settlement with the Fresch house application. The owner paid a $500 fine in Vernon Township Municipal Court and is now in the process of doing the connection work necessary.

Mr. Scerbo also reported the Vernon Municipal Court judge issued a $500 bench warrant to James Dobson, owner of the Church Street building with the photography business, for failure to appear in court on a summons from the VTMUA.

13. Executive Session—Potential Litigation

WHEREAS, the Open Public Meetings Act, N.J.S.A. 10:4-6 permits the exclusion of the public in certain circumstances; and

WHEREAS, this public body is of the opinion that such circumstances presently exist.

NOW, THEREFORE, BE IT RESOLVED by the Vernon Township Municipal Utilities Authority of the Township of Vernon as follows:

1. The public shall be excluded from discussion of and action upon the hereinafter-specified subject matter.
2. The general nature of the subject matter to be discussed is potential litigation.

Return to Open Session

The VTMUA came out of executive session at 9:08 p.m. and reconvened public session.

Attorney Richard Wenner stated that the Executive Session had been for the purpose of discussing potential litigation. No further action will be taken at this time regarding the Executive Session matter.

14. Correspondence

The commission received a letter from Phyllis Pfeifer resigning her position as commissioner due to an anticipated move from Vernon Township. Ms. Pfeifer said she is sorry to leave Vernon but it is time to do so since the passing of her husband. She said she has enjoyed being on the VTMUA and has learned so much. The commissioners wished her the best in her future.

Motion to accept the letter was made reluctantly by Edward Snook. The motion also included authorizing the executive director to send a letter to the Vernon Township Council advising them of a vacancy on the VTMUA as a result of Ms. Pfeifer’s resignation and also requesting the executive director to send Ms. Pfeifer a letter thanking her for her service.

The motion was seconded by Vincent Zinno.
