Call to Order

The regular meeting of the Vernon Township Municipal Utilities Authority (VTMUA) of the Township of Vernon was convened at 7:00 p.m. on Thursday, November 12, 2015 in the Vernon Municipal Center, 21 Church Street, Vernon, New Jersey.

Statement of Compliance

Adequate notice of this meeting had been provided to the public and the press on January 15, 2015 and was posted on the bulletin board in the municipal building in accordance with the Open Public Meetings Act, N.J.S.A. 10:4-6.

Executive Director John Scerbo reported Commissioner Thomas Buchney would not be present for the meeting due to a death in his family. The commission members offered their condolences.

9. Engineer’s Report

A. Review of New Applications

John Scerbo gave the report on the EDU allocations for the Black Creek Sanctuary common areas, i.e. pools, hot tubs, and affiliated rest rooms. These areas are assessed 6.5 EDUs, based on VTMUA regulations of 15 gallons per day per visitor. The flow must be estimated using the maximum population allowed at the pool facilities. The VTMUA did a site visit and determined that there were a total of 89 chairs present at the facility. Based on that calculation, the association will be assessed an EDU count for 1,335 gpd for the pool area and its amenities, totaling 6.5 EDUs. The billing for these common areas will go to the association. The association will be responsible for payment. The association will be charged retroactively to July 2013.

10. Executive Director’s Report

Executive Director John Scerbo reported that only six properties in the sewer service area remain unconnected and one of those properties might result in a court case. He also reported that Lukoil and the Fraisch house were connected this past week.

He reported that there is still about $98,000 owed to the VTMUA in fees, $30,000 of which are from unpaid 2014 bills. Those properties will go on tax sale. The remaining approximately $60,000 are due to properties currently in foreclosure. He said the banks holding the mortgages, however, are mostly paying the fees to avoid liens on the properties, as the VTMUA is the first lienholder.

Mr. Scerbo also reported that Joe Duffy, a township veteran, thanked him personally for the factual information Mr. Scerbo had published regarding the situation with the VFW Post 8441 sewer connection. There had been much misinformation about the matter, and Mr. Scerbo set forth the facts and all the assistance the VTMUA had given to the VFW with regard to their sewer connection and fees.

Mr. Scerbo also reported that he was getting a number of responses from the sewer users regarding electronic payments for fees. A survey had been put in the last VTMUA newsletter asking users what was their preferred method of billing and payment.

12. Chairman Comments

Chairman Vincent Zinno mentioned the VTMUA would soon be discussing its budget for 2016. While he said there might be an increase in fees, he noted that the VTMUA still has the lowest sewer fees from any other municipality in the county. There was no increase in fees last year.


A motion to adjourn the meeting was made by James Kensek at 7:09 p.m. and seconded by Vincent Zinno.

There will be two VTMUA meetings in December. The next meeting of the VTMUA will be on December 2, 2015 at 7 p.m. The second meeting in December will be held on December 16 at 7 p.m.
