Call to Order

The regular meeting of the Vernon Township Municipal Utilities Authority (VTMUA) of the Township of Vernon was convened at 7:00 p.m. on Thursday, October 9, 2014 in the Vernon Municipal Center, 21 Church Street, Vernon, New Jersey.

Statement of Compliance

Adequate notice of this meeting had been provided to the public and the press on January 2, 2014 and was posted on the bulletin board in the municipal building in accordance with the Open Public Meetings Act, N.J.S.A. 10:4-6.

Attorney John Ursin, Engineer Ceren Aralp, Auditor Charles Ferraioli, and Executive Director John Scerbo were also present.

1. Oath of Office

John Ursin administered the oath of office to Roy Tanfield for his new position on the VTMUA as a regular member.

2. Open Meeting for Public Comment

Motion to open the meeting to the public was made by Phyllis Pfeifer.
Seconded by Gloria Gallo

6. Resolutions

A. Resolution 14-32: Approving the Amendment of the Memorandum of Agreement between the Township of Vernon and the Vernon Township Municipal Utilities Authority Amended October 9, 2014

The original agreement between the Township of Vernon and the VTMUA was executed in 2011. This resolution modifies and clarifies the agreement upon the recommendation of the auditor and risk manager.

The motion to approve the resolution was made by Roy Tanfield.
James Kensek seconded the motion.

The motion to approve the resolution was made by Phyllis Pfeifer.

7. Attorney’s Report

Attorney John Ursin said he felt the Collocia lawsuit against the VTMUA and the Township of Vernon would soon be resolved.

9. Engineer’s Report

A. New Business—Review of Applications

1. Approval of EDU Flow Count for Block 141, Lot 10.03—2.5 EDUs

Located at 3 Church Street, this building consists of commercial space and 1 residential unit. The commercial space consists of 1300 square feet and will be used as a florist.

Gloria Gallo made a motion to approve, contingent upon the engineer’s recommendations.
Thomas Buchney seconded the motion.

2. Approval of EDU Flow Count for Block 144.01, Lot 5, LukOil North America LLC—4.75 EDUs

This property is the LukOil Gas Station and mini market, owned by Christina Sanders. It consists of 8 filling stations and a 1,650 square foot mini market. The property owner confirmed there are no floor drains in the building that would discharge to the sewer system. The engineer is waiting for revised drawings; no building permit will be issued until the drawings are received.

A motion to approve was made by Thomas Buchney.
James Kensek seconded the motion.

B. Old Business—Updates on Prior Approved Applications

1. Block 141 Lot 2, Master Plumbing

Revised drawings have been submitted.

2. Block 142 Lot 2, Residential Unit

Revised drawings are needed for review.

3. Block 148 Lot 4, St. Thomas Church

This property needs a lift station. The pipe connect is six feet farther down than previously thought. Revised drawings are being reviewed.

10. Executive Director’s Report

Executive Director John Scerbo reported on property owners that have been unresponsive to connecting to the sewer system. He said despite multiple correspondences since 2012, the property owners have not filed an application or a plan and have not connected to the sewer system. Those properties are the following:

Block 141 Lot 15.05 Dunkin’ Donuts
Block 141.01 Lot 12 Tara Properties
Block 144.01 Lot 7 Fresch House

Mr. Scerbo recommended having the VTMUA attorney send a final warning letter to the property owners stating that if they do not take action summonses will be issued to them. The property owners are currently being billed.

A motion to authorize the attorney to send the letters was made by James Kensek.

Mr. Scerbo further stated that Brookside Florist (Block 145, Lot 7) and the VFW Post 8441 (Block 148, Lot 8) both have deferred connections per approval of the VTMUA by resolution.

11. Commissioners’ Comments

Commissioner Roy Tanfield stated his opinion that the Mountain Creek Water Park would be good for the VTMUA because it would result in a significant increase in sewer fees and would make the sanitary sewer system solvent.

12. Chairman Comments

Chairman Vincent Zinno said he was pleased with the operations of the VTMUA and thanked the commissioners and the professionals for their roles in the process.
