Call to Order

The regular meeting of the Vernon Township Municipal Utilities Authority (VTMUA) of the Township of Vernon was convened at 7:00 p.m. on Thursday, September 17, 2015 in the Vernon Municipal Center, 21 Church Street, Vernon, New Jersey.

Statement of Compliance

Adequate notice of this meeting had been provided to the public and the press on January 15, 2015 and was posted on the bulletin board in the municipal building in accordance with the Open Public Meetings Act, N.J.S.A. 10:4-6.

5. Correspondence

Letter from Wallkill Valley Memorial Post 8441 VFW

Letter dated September 11, 2015, requesting a hardship payment plan for the payment of their sewer connection fee due to their existing financial position

Jim Davis, Commander of VFW Post 8441, sent a letter requesting a hardship payment plan for the connection fee to the sewers. Mr. Davis said the VFW has had a lack of communication with the VTMUA, but they have corrected their failure. He also said the post’s financial condition has improved and their utility bills are current, but they need more time to pay the connection fees and, therefore, request the hardship payment plan.

Motion to receive and file the correspondence was made by Edward Snook.

6. Other Resolutions

A. Resolution 15-43: Correcting the Amount of Overpayment Calculated as a Refund in Resolution 15-41, which was Authorized as a Transfer to Partially Pay the Sewer Connection Fee for Block 141.01 Lot 12, Tara Properties at 5 Church Street

The EDU calculation for this property was changed from 2.5 EDUs to 1.75 EDUs. The payments made at the higher EDU count resulted in an overpayment in the amount of $1,282.50. The property owner wishes to apply the overpayment to the first payment of the connection fee owed to the VTMUA, which according to the property owner’s hardship payment plan is $1,755.21 and due on August 1, 2015.

B. Resolution 15-44: Granting a Hardship Payment Plan for the Wallkill Valley Memorial Post 8441 for Connection to the Vernon Sanitary Sewer System

The VFW post is assessed 4.5 EDUs and a connection fee of $20,992.50. The applicant shall pay the connection fee in five installment payments plus 1-1/2% interest per year. Each payment shall be $4,513.39 and due annually on the first of the month based on the month the hardship plan is initiated during the one-year connection deferral from July 1, 2015 to June 30, 2016.

The motion to grant the hardship payment plan was made by Edward Snook.

C. Resolution 15-45: Updating the VTMUA Rules and Regulations Concerning a Property Owner’s Failure to Hook Up to the Sewer System by the Mandatory Hook Up Date

Section 3.6, Mandatory Connection, is hereby amended by deleting subsection (C) in its entirety and replacing it as follows.

Should the owner of any property fail or neglect to connect to the public sewer system pursuant to Subsection A above, unless the property owner has applied for and received a hardship connection deferral from the VTMUA, the owner of the property shall be responsible for paying user fees in the same amounts as if the property had been connected, starting at the expiration of the 180 day period. The user fees shall be based upon an estimated EDU count determined by the VTMUA engineer in consultation with the township assessor. Upon the submission of an application for connection and approval of an EDU count by the VTMUA, the property owner will be responsible for the retroactive payment of any shortfall in sewer fees in the event the actual EDU count is greater than the estimated EDU count. Nothing contained herein shall relieve the owner of any property from being subject to the penalty provisions set forth in Section 6.2 for violations of this chapter.
